Moki Terms of Service

1. Acceptance of Terms

By installing, accessing, or using Moki ("the extension", "the service", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Moki.

These Terms constitute a legally binding agreement between you and Moki. Please read them carefully.

2. Description of Service

Moki is a Chrome browser extension that helps users learn languages while watching YouTube videos. Our services include:

Real-time subtitle translation on YouTube
Dictionary lookups with context-aware definitions
Vocabulary saving and collection management
Video learning history tracking
Export functionality to Anki flashcard application

3. Eligibility

You must be at least 13 years old to use Moki. By using the service, you represent and warrant that you meet this age requirement.

If you are using Moki on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

4.1 Account Requirements

To access Moki's features, you must create an account by providing:

A valid email address
A password (8-12 characters)
Optionally, a display username

4.2 Account Responsibilities

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Providing accurate and up-to-date information

4.3 Account Security

We implement industry-standard security measures, but you acknowledge that no system is completely secure. You agree not to share your password or allow others to access your account.

5. Subscription and Payments

5.1 Free and Paid Features

Moki may offer both free and premium subscription tiers. Feature availability may vary between tiers.

5.2 Payment Processing

All payments are processed securely through Stripe
By subscribing, you authorize us to charge your payment method on a recurring basis
Prices are listed in the currency specified at checkout and may include applicable taxes

5.3 Billing Cycle

Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected)
Your subscription will automatically renew unless cancelled before the renewal date

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
We do not provide refunds for partial subscription periods, except as required by law

5.5 Price Changes

We reserve the right to modify subscription prices. We will notify you of any price changes at least 30 days before they take effect. Continued use after the price change constitutes acceptance.

6. Acceptable Use

6.1 You Agree To:

Use Moki only for lawful purposes
Comply with all applicable laws and regulations
Respect the intellectual property rights of others
Use the service in accordance with YouTube's Terms of Service

6.2 You Agree NOT To:

Share your account credentials with others
Attempt to reverse engineer, decompile, or disassemble the extension
Use automated systems or bots to access the service
Circumvent any access restrictions or usage limits
Use the service to infringe upon others' intellectual property
Transmit malware, viruses, or harmful code
Interfere with the proper functioning of the service
Resell, redistribute, or commercially exploit the service without authorization
Use the service to collect data about other users

7. Intellectual Property

7.1 Our Intellectual Property

Moki, including its code, design, features, and content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the extension for personal, non-commercial purposes.

7.2 Your Content

You retain ownership of any vocabulary collections, notes, or other content you create using Moki. By using our service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.

7.3 Feedback

If you provide feedback, suggestions, or ideas about Moki, you grant us the right to use such feedback without obligation to you.

8. Third-Party Services

8.1 YouTube

Moki operates on YouTube.com. Your use of YouTube is subject to Google's Terms of Service and YouTube's Terms of Service. We are not affiliated with, endorsed by, or sponsored by Google or YouTube.

8.2 AI Language Processing

We use third-party AI services (via OpenRouter) for translation and language processing. These services process subtitle text in real-time and do not store your data.

8.3 Payment Processing

Payment processing is handled by Stripe. Your use of Stripe is subject to Stripe's terms of service and privacy policy.

8.4 Anki Export

The Anki export feature communicates directly with your local Anki application via AnkiConnect. We are not affiliated with Anki or AnkiConnect.

8.5 Third-Party Disclaimer

We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is at your own risk.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers

10.1 Service "As Is"

MOKI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of translations
Uninterrupted or error-free operation

10.2 Translation Accuracy

Translations and language processing are provided by AI systems and may contain errors. Moki is intended as a language learning aid and should not be relied upon for professional translation purposes.

10.3 YouTube Compatibility

We do not guarantee continuous compatibility with YouTube. YouTube may change its platform at any time, which could affect Moki's functionality.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOKI, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruption or inability to use the service
Any damages arising from your use of third-party services

11.2 Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF MOKI SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11.3 Basis of the Bargain

The limitations in this section reflect the allocation of risk between you and us and are essential to our ability to offer the service at the current price.

12. Indemnification

You agree to indemnify, defend, and hold harmless Moki and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Your content or data

13. Termination

13.1 Termination by You

You may stop using Moki at any time by uninstalling the extension and, optionally, deleting your account.

13.2 Termination by Us

We may suspend or terminate your access to Moki at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

13.3 Effect of Termination

Upon termination:

Your right to use Moki immediately ceases
We may delete your account and associated data
Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive

14. Changes to Terms

We may modify these Terms at any time. When we make changes:

We will update the "Last Updated" date at the top
For material changes, we will notify you via email or through the extension
Your continued use of Moki after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using Moki.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at hello@mokiedu.com. We will attempt to resolve the dispute within 30 days.

15.2 Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

15.3 Jurisdiction

Any disputes arising from these Terms or your use of Moki shall be resolved in the courts of Singapore.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Moki.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

16.5 No Agency

Nothing in these Terms creates any agency, partnership, or employment relationship between you and us.
